Some states have the father take counseling beforehand, and others require a compelling reason before granting a request. Some states will deny almost any request. There is no guarantee that you can relinquish your parental rights.

    • 2). Make sure you understand what relinquishing your paternal rights entails. Find out if you will still need to pay child support, especially if the child is going back to his mother. In cases of adoption, you most likely will not be held financially responsible for the child.

    • 3). File the necessary forms for the courthouse and have them notarized. Fill out this paperwork with the help of an attorney if you need help understanding the terms involved.

    • 4). Go to your court hearing to see if your request for parental relinquishment is granted. You will need to be present to answer questions the judge may have. Your request can be denied for any reason, especially if the judge decides that the child will be better served having both parents in his life.

    • 5). Explain to the judge that you comprehend what your decision will mean for yourself and the life of your child and give your reason for giving up your father's rights. The judge will then decide whether to grant your request.
