    • 1). Schedule any necessary appointments with a physician. If you are applying to be a guardian over an adult, your petition will likely have to include a medical evaluation. The evaluation should state that the adult cannot take care of himself or herself independently. In some jurisdictions, guardianship over minors also requires a medical examination.

    • 2). Complete a petition to become a guardian. This form can be found at the family courthouse in the county where your proposed ward resides. In some states, the document can also be downloaded online.

    • 3). File the completed form with any necessary medical affidavits with the probate court clerk at the county courthouse. Pay the required filing fees, which will vary by state. Make copies of your petition for your records.

    • 4). Notify other parties involved in the case of the proposed guardianship if required. The court clerk will assign a hearing date. Depending on your state's law, it will be your responsibility to notify other people involved of the court date. Ask the clerk for the requirements. If you have to give notice, there are specific rules you must follow.

    • 5). Meet with the investigator. The court will assign an investigator or guardian ad litem to determine the best interests of the proposed ward. The investigator will interview you, the ward, other family members, physicians and other agencies involved in the care.

    • 6). Attend the hearing. Make your case for why you think you should be a guardian over this individual. The investigator will also provide his conclusions about the case at the hearing. If you are awarded guardianship, the judge will provide you with Letters of Guardianship.

    • 7). Complete necessary paperwork annually. If you are the guardian, the court will mail out a review every year. It is important that you complete the paperwork to remain the guardian.
