How to Get Logos Trademarked
- 1). Begin your trademarking process by visiting USPTO's website at www.uspto.gov.
- 2). Ensure that your trademark is unique and original. It should not be a commonly identifiable symbol. Research other trademarks on the USPTO's searchable database and make sure there is not a trademark that is the same or similar.
- 3). Save a digital copy of your trademark that is in a JPG file format and has an RGB color scheme.
- 4). Fill out the initial trademark application, which can be filed electronically on the website. Use the "Intent to Use" application if your trademark is still being developed. Upload your image and pay the processing fee.
- 5). Wait while the USPTO reviews your application. An attorney will examine your trademark and send you the office's determination. If your trademark is rejected, you will be given the opportunity to appeal the decision to the Trademark Review and Adjudication Board. This must be done within 15 days of the rejection letter postmark date. If approved, they will post your trademark temporarily to give other companies an opportunity to protest your trademark. After this time, your trademark will be officially registered.
- 6). Keep the trademark active by using it regularly and by renewing the trademark registration and paying registration dues every 10 years.
