How to Patent a Mining Claim

    • 1). Hire the appropriate companies to perform the necessary tests and analysis of the land to prove the existence of valuable resources. You must prove that there is a valuable mineral deposit on your claim. Geological surveys, geologic maps, geochemical analysis and mineral samples are all acceptable forms of proof.

    • 2). Perform a minimum of $500 worth of improvements on the claim. Hire a company to clear and clean the location and correct any problems such as the removal of trash and fallen trees. You will need to record all of the dates and expenditures related to the improvement of the claim. The Bureau of Land Management (BLM) requires that $500 worth of labor must have been used to improve your claim before you submit your application.

    • 3). Hire an approved surveyor to perform a mineral survey. The BLM requires that a mineral survey must be done by a surveyor approved by their agency. Choose one from the list of approved surveyors supplied by the BLM.

    • 4). Post a notice of intent to patent and clearly mark off the boundaries of your claim. Display the sign clearly on your claim and publish your intent to patent in your local periodical for at least 60 days. Use posts and rope to mark off the exact boundaries of your claim.

    • 5). Apply for a patent with the Bureau of Land Management. Submit your application with all of the supporting evidence and the non-refundable fee of $250 to the BLM (as of 2010). If your application is approved, you will also have to pay a per acre purchase fee.
