Skills Development Levy Act

    Imposition

    • The Skills Development Levy Act states that every employer in the Republic of South Africa is lawfully required to pay a skills development levy to their municipality annually. Levies paid to the Commissioner and to SETA are then distributed in accordance with this act.

    Recovery

    • If a company either doesn't pay the levy or doesn't pay the amount due, labor inspectors will investigate the case. It is the responsibility of the labor inspectors to both monitor and enforce compliance with the Skills Development Levy Tax.

    Provisions

    • The Skills Development Levy Act defines offenses as anyone who doesn't register for levy, doesn't pay the levy, provides false information regarding levy payment, or hinders the collection of levy in any way. This section of the Act also gives the Minister of Finance the authority to make necessary adjustments to the regulations set forth in this act.
