Does FMLA Apply to Churches?
- Richard M. Brennan at the Department of Labor states that the law contains no formal suggestions that churches are exempt from FMLA. If the institution and the employee both meet the requirements, then the church is required to offer employees FMLA just like any other private business.
- According to the Department of Labor, FMLA law includes churches and other religious organizations if they employ at least 50 people and the employee meets the criteria for FMLA entitlement.
- A church employee's job will be protected if they require unpaid time off to care for themselves or an immediate family member experiencing severe health issues, or if they require a leave of absence due to pregnancy or after childbirth.
