How to Travel With a Spouse on a B-1 Visa

    • 1). Apply for a B2 visitor visa if you don't already have a visa. You must apply through the nearest U.S. consulate general or embassy that has jurisdiction over your area of residence. You must complete the online visa application DS-160 and schedule an appointment with the consulate online. At the interview, you must present your passport, photo, proof of the intent of your trip and proof that you will be financially covered during your stay in the U.S. and a bank receipt of $140 (as of March 2011) paid to the designated bank. You must visit your specific consulate website for information concerning where to pay the application fee. If your visa application is approved, your passport and visa will be returned to you by mail.

    • 2). Enter the United States. It does not matter that you enter the U.S. on a B2 visa and your spouse enters on a B1 visa --- persons holding any type of visa are allowed to travel together. While in the U.S., you cannot engage in any of the business that your spouse is conducting. You must restrict your activities to those of travel and pleasure.

    • 3). Exit the U.S. before or by the expiration date on your I-94. When you enter the U.S. you will be given a date on which you must exit by, this is known as an I-94. You must leave by this date or you will be considered out of status and subject to immigration penalties. If your spouse's I-94 allows for a longer stay in the U.S. than yours, you can file an extension to remain longer with the United States Citizenship and Immigration Services no later than 45 days before the expiration of your I-94. To file extension, submit a completed application Form I-539 to the USCIS. If your B1-holding spouse also requires an extension, they must file a separate I-539.
