How to File Patents in the U.S.
- 1). Open your Web browser and navigate to the U.S. Patent Office's EFS-Web -- its electronic patent-filing application system.
- 2). Sign on to the eFiler by providing your name and your e-mail address. Click on "New application" and select the type of patent application you are filing (Utility, Design or International Application for filing in the U.S. receiving office). Click "Continue."
- 3). Enter the name of the invention, your name (if you are the first named inventor) and your contact details (phone number or address). Click "Continue."
- 4). Attach all of the documents in PDF form related to your invention. This is the most important part of your application, so make sure you are including everything the patent office needs to review your patent application.
- 5). Determine what your fees will be for filing your patent.
- 6). Review your patent application and pay your fees by using a valid credit card.
- 7). Wait for a representative from the U.S. Patent and Trademark Office to contact you. He will contact you if he has further questions or concerns about your application or to notify you that your patent has been successfully filed.
