- 1). Speak to an Arkansas family law attorney, and discuss child custody, termination of parental rights and other legal matters affecting your child. While you may have to pay for the meeting, you do not have to hire the attorney, and you could receive invaluable information on how to proceed next.
- 2). Write a petition to terminate the parent’s parental rights. The petition must contain the names and addresses of the mother, father and child. It must state your relation to the child, state that the child lives in Arkansas (and is therefore under the jurisdiction of an Arkansas court) and list the reason for revoking the parental rights of one of the parents.
- 3). File the petition in an Arkansas family law court located in the county where the child lives. You must also deliver a copy of the petition to the other parent (the one whose rights you are seeking to revoke).
- 4). Attend the hearing set up by the court, and argue your case to the judge. The evidence must be “clear and convincing,” a heightened evidentiary standard whereby the facts must convince the judge that your claim is substantially more likely to be true than false.
