- 1). Outline the specific matters that are at issue in your divorce case. These points likely include division of assets and debts, child custody and parenting time, child support and related topics.
- 2). Set forth your specific position in regard to the outstanding issues in your divorce case. For example, if you desire to be awarded residential custody of your children, list that as an objective in your position paper for divorce.
- 3). Prioritize the outstanding issues in your divorce case in order of importance. Not all matters at issue in your case are of equal importance. By making a priority list you are able to identify those points that you are more willing to negotiate.
- 4). List any issues on which you think your spouse will take a firm position in opposition to your own. By identifying these elements you are better able to mount an appropriate argument in support of your own position--both in negotiations and in a court hearing, if necessary.
