Statute of Limitations on Restitution
- Payment to the state, victim or both, for damages, is called restitution. The courts do not take into consideration an individual's ability or inability to pay the ordered amount.
- Three types of restitution exist: restitution fines, parole revocation fines and direct orders. All three types of restitution can be ordered by the court.
- Restitution never goes away. Even if bankruptcy is declared, the restitution is still owed.
Revocation of parole or probation may occur for non-payment. Referral to a government collection agency may also occur. - Restitution has no statute of limitations. Restitution is owed until the full amount is paid.
