How to Stop a Garnishment After Filing Bankruptcy
- 1). Contact a local attorney who specializes in bankruptcy. Schedule an appointment to review your financial situation and determine whether you do, in fact, qualify for bankruptcy.
- 2). Meet with the attorney at the scheduled time. Answer all of his questions about your finances. He will need to know all of your financial information, including how much money you bring in and how much you spend each month. Your expenses are not only your bills but also the amounts you spend on incidentals such as gas and clothing.
- 3). Fill out any paperwork the attorney gives you. He will fill out the bankruptcy paperwork that will be submitted to the court. Pay him the filing fee.
- 4). Have the attorney contact the creditor who is garnishing your wages. He can contact the creditor and request an immediate stop to the garnishment once the bankruptcy paperwork has been filed. Once you have retained the attorney, let him handle all contact with your creditors.
- 5). Provide the human resources department at your place of work with the first page of your bankruptcy filing. This page will have a stamp from the court showing the date your bankruptcy petition was filed. The financial department of your company should now refuse any garnishment requests.
- 6). Check your next pay stub and make sure the garnishment has ended. If you continue to see payments withdrawn, contact your attorney and HR department immediately.
