- 1). Prepare the document that you plan to record. Many documents can be prepared without the need for an attorney; however, the advise or services of an attorney may be necessary to ensure that the document meets any Texas legal requirements for form or substance.
- 2). Mail the document to the New York party or parties. Have the party or parties sign the document in front of a certified notary public for the state of New York.
- 3). Return the document to Texas through hand delivery or certified mail. Original legal documents should always be delivered in person or mailed with a delivery signature required.
- 4). Take the document to the county courthouse where the document will be recorded. Record the document with the clerk of courts for the county. Texas Civil Practice and Remedies Section 121.001(b)(3) specifically allows an instrument to be acknowledged by a notary public from another state.
