Aggravating Circumstances

• A harsher penalty will result if there are aggravating circumstances. Aggravating circumstances include driving 30 mph over the speed limit, causing an accident resulting in death or serious injury, having a blood alcohol concentration that exceeds 0.15 within two hours after operating the vehicle, driving the wrong way on a limited access freeway, refusing to submit to alcohol testing and transporting a passenger younger than 12.
  
  

First Offense

• As of November 2010, the penalty for the first offense is a fine of $200 to $500, two to 30 days in jail, license suspension for 30 to 120 days or 48 hours to 30 days of community service in lieu of a fine and/or imprisonment. An aggravated offense will result in imprisonment for four days.
  
  

Second Offense

• The penalty for the second offense is a fine of $350 to $500, seven days to six months in jail, 12 to 18 months license suspension and 10 days to six months of community service. An aggravated offense will result in imprisonment for 14 days.
  
  

Third Offense

• The penalty for the third offense is a fine of $500 to $1,000, 30 days to 12 months in jail, license suspension for 24 to 36 months and 10 days to 12 months of community service. An aggravated offense will result in imprisonment for 60 days.
  
  

Fourth Offense

• A fourth offense is a Class D felony. It is punishable with a minimum term of imprisonment for 120 days and a six-month license suspension. An aggravated offense will result in imprisonment for 240 days.
