How to File an Appeal for Seized Property
- 1). Contact an IRS manager or your local clerk of court depending on the type of seizure you are facing. Ask that your case be reviewed to ensure accuracy.
- 2). Request an appeal hearing in writing no more than 30 days after seizure of your property. Some states require a wait time of no more than 21 days to file an appeal. Your appeal can be mailed to the IRS office address on your seizure notice or your local clerk of court.
- 3). Gather all evidence that your back taxes were paid before the notice was served, your innocence in any criminal activity associated with your property or dispute of any financial claims against you.
- 4). Attend the predetermined hearing. The IRS will hold a hearing at your local IRS office in front of an appeals committee while criminal appeal cases are heard by a judge in a courtroom setting.
- 5). Discuss your options with an attorney should your appeal be denied. You have the right to bring suit against the IRS or county issuing the seizure order. It is important to remember that a lawsuit will not always turn out in your favor and you may be spending more than your property is worth.
