- 1). Collect all of the necessary documents. You will need each of the documents listed as sources for information, and some of the documents will be filed with the court.
- 2). Complete a credit counseling course. Use the link provided below to locate an approved credit counseling agency in your area. Credit counseling must be completed within, but not more than, 180 days before you file your bankruptcy petition.
- 3). Fill out the voluntary petition form. You can find a copy of the form using the link provided below. If you are having trouble filling out the form, consult an attorney or pay a petition preparer to help you file the paperwork.
- 4). Attach your tax return and wage stubs to the voluntary petition. Copies of these documents must be included even if you listed all of the information on the petition form.
- 5). Sign the petition. If you prepared the petition yourself, only your signature must appear at the bottom, and you can leave the other boxes blank. But if you had help preparing the form, the person who helped you must also sign the form.
- 6). File the petition with the necessary exhibits. You can either mail a copy of your petition or hand deliver a copy.
