How to File an EEOC Complaint in Georgia

    • 1). Go to the Georgia EEOC office at the Sam Nunn New Federal Building, 100 Alabama Street, SW, Suite 4R30 in Atlanta. You may also call the EEOC national office toll free at 800-669-4000. Whether you make the first contact by phone or in person, a representative examines the information you provide to determine whether the EEOC is the correct agency to help you.

    • 2). Fill out an online assessment as an alternative to initially contacting the Georgia EEOC office in person. The tool is available on the website of the EEOC (see References). The questionnaire asks for the employer's and your contact information, as well as for a brief description of the discriminatory event, including the names of anyone who witnessed it. You will be contacted after a staff member reads the information and determines whether the EEOC should take your case.

    • 3). Follow the instructions you receive from the EEOC staff to file the charge. The EEOC's initial response might be to send you and the employer to mediation, an option either party has the right to refuse. When mediation isn't used or fails to resolve the dispute, the EEOC investigates your complaint to determine whether you are a victim of employer discrimination. The office tries to settle the matter with the employer if it finds that you were discriminated against. If the employer does not agree with the proposed settlement, the EEOC sends you a letter that authorizes you to file a lawsuit. Sometimes, but seldom, the EEOC takes the employer to court on your behalf.
