Pool Fence Act

Florida

• Florida enforces the Residential Swimming Pool Safety Act, also referred to as the Preston de Ibern/McKenzie Merriam Residential Swimming Pool Safety Act. This law mandates the placement of a minimum of a 4-foot barrier around the perimeter of any outdoor pool. However, the fence must not be erected immediately adjacent to the pool.
  
  

Arizona

• Arizona law demands a minimum of a 5-foot fence around any outdoor swimming pool that holds water 18 inches or more in depth. The barrier must not include any exterior hand or footholds. "The wall, fence or barrier shall be at least 20 inches from the water's edge," reads the legislation.
  
  

Guidelines

• No federal law in the United States regulates pool fencing requirements, but a wide assortment of additional states, counties, cities and municipalities have similar yet varying mandates. The Consumer Product Safety Commission has established a list of guidelines intended to help homeowners properly secure their outdoor swimming pools.
