Laws From the Nevada Revised Statutes That Affect Custody and Visitation Schedules

103 2
Separated or divorced parents in Nevada must become family with Title 11, Chapter 125 in the Nevada Revised Statutes.
This section of law contains the information about child custody matters, and it is of particular importance when creating a custody and visitation schedule.
Since the custody schedule is such a large part of any custody proceeding, the state has specific laws addressing it.
Here is a brief overview of some of those laws.
The first decision for the custody schedule is what type of custody the parents want.
Chapter 125 says that parents have the option for a joint custody schedule if it is best for the children.
The state also allows one parent to be the custodial parent and the other parent to have visitation rights.
When setting up a visitation schedule, the mother and father must make sure that adequate time is given to both parents.
The court looks favorably on parents who are both involved with the child.
When deciding on a custodial parent for the schedule, the parents should choose based on the needs of the child.
Nevada law gives no preference to either parent as the custodial parent.
The mother and father have an equal right to this.
If parents choose a joint custody arrangement, they can have joint legal custody without joint physical custody.
The custody and visitation schedule must be made in the best interest of the child.
The court considers the welfare of the child as the sole consideration when making any custody decisions.
Some of the factors that the court looks at when determining custody are: the wishes of the child, if the parents are able to cooperate, if either parent promotes the child having a relationship with the other parent, the level of conflict between the parents, if the child has a relationship with a sibling, etc.
Parents should also consider these factors when making the schedule.
