- 1). Prepare a citation to discover assets and a citations notice form. Many clerk offices have these forms available for you to use. If they are not available at the court clerk's office where you obtained the judgment, then you may use the forms found on the Illinois Legal Aid website. Make three copies of each form and keep one for your records.
- 2). File the citation-to-discover-assets form and citation notice forms along with two copies of each with the court clerk's office where you originally obtained the judgment. The court will give you a time and date for a hearing when you file the forms.
- 3). Serve the defendant with a copy of both the citation to discover assets and citations notice.
- 4). Appear at the hearing. If the debtor appears for the hearing, the judge will question the debtor regarding his income and assets to determine if he is able to pay the debt. If the judge determines that the debtor is capable of paying the judgment, she will issue an order to pay that will include whether the debtor is ordered to pay the debt in full immediately or in installment payments.
- 5). File the order to pay with the clerk. Provide a file-stamped copy to the debtor.
- 6). Seek the assistance of an attorney if the debtor fails to abide by the order to pay. You may have further options such as placing a lien on the debtor's personal or real property, garnishing the debtor's wages, or garnishing a bank account. These additional remedies are more complicated and should be done with the help of an attorney.
