What Are the Consequences for Filing a False Police Report in the State of Kansas?

    Criminal Record

    • Filing a false police report is a Class A Non-Person Misdemeanor. A Class A Misdemeanor is the most serious classification of misdemeanors, and a misdemeanor is less serious than a felony. Filing a false police report is considered a crime that affects property, hence the "non-person" classification. Other Class A Misdemeanors include second offense drunken driving, possession of marijuana and theft.

    Jail Time

    • A Class A Misdemeanor is punishable in Kansas by up to 1 year of confinement in the county jail. The judge will determine the amount of jail time based on the specifics of the case and the convicted person's criminal background. The judge will also be allowed to grant probation instead of jail time.

    Fines

    • As of April 2011, a Class A Misdemeanor is punishable with a fine up to $2,500, but Kansas police agencies can also request restitution for the amount of money spent investigating the false police report. For example, police could request being compensated for the hourly pay for the officers who had to investigate and the costs associated with any equipment used, like police cars or helicopters. The judge will make the ultimate determination about fees and restitution.

    Legal Fees

    • On top of fines associated with the sentence, a person accused of a crime must hire and pay for a defense lawyer during the court proceedings. In 2011, lawyers' fees and hourly rates can cost more than $1,000, based on the lawyer selected and the number of hours spent in court. A court-appointed lawyer can be provided, but the accused must prove they cannot afford a lawyer. Sometimes the court will order the accused to repay the legal fees as part of the sentence.
