• Typically, a small claims court will hear cases for amounts up to several thousand dollars. For example, New York City small claims courts deal with cases for up to $5,000. In California, you can sue for up to $7,500. In the state of Pennsylvania, you can typically sue for up to $8,000, but in Philadelphia that amount goes up to $10,000. • Make sure to choose the appropriate court for your complaint. Generally, small claims cases must be heard either where you live or work or where the party you're suing lives or works. If you're unsure about where to file your complaint, check with the court that has jurisdiction where you live.

Filing Your Complaint

• The fastest and easiest way to have your case heard is to file your complaint in person at the courthouse or clerk's office you've chosen. If you file your complaint in person, the court clerk or interviewer can check your paperwork while you're there and quickly correct any mistakes. You can also pay your fees while there, further expediting the process. If you can't file your complaint in person, however, you can usually file through the mail.
  
  

After You File

• When you file your complaint, the court clerk will schedule your hearing time and arrange for the party you're suing to receive notice of your complaint. Generally, the court serves complaints using certified mail or the local sheriff's office and may charge you a different fee depending on which service you choose. On the day of your hearing, arrive early and bring any evidence you've gathered.
