- 1). Determine the correct jurisdiction. The Conciliation Courts are divided into 10 different Judicial Districts, with each representing a number of Minnesota counties. A complaint must be filed in the Judicial District that oversees the county in which the person resides or the business is located. There are some exceptions. For example, a landlord who is suing a tenant over money owed on a rental property would file a complaint in the court that presides over the county in which the rental property is located.
- 2). File your complaint. You can download the legal forms online or go to the court in person. The Court Clerk can assist you with filing the necessary paperwork to process and file your particular complaint. In your complaint, describe the facts of the complaint and why you are seeking monetary damages. Also enter your contact information and the contact information for the defendant.
- 3). Pay all applicable fees. Fees vary per type of complaint and per judicial district and, in some cases, per county in each district. For example, in 2010 the Fifth Judicial District charged $65 to file a basic small claims complaint versus the Tenth Judicial District, which charged $75.
