Marina, CA: Health Care Reform Law Hits Another Legal Hurdle: View From A Private Duty Caregiver Serving, Carmel, Carmel Valley, Carmel-by-the-Sea, Gilroy, Gonzalez, Greenfield, Hollister, King City, Marina, Monterey, Pacific Grove, Pebble Beach, Salinas, San Juan Bautista, Seaside And Soledad CaliforniaPresident Barack Obama's health care reform law has been getting mixed legal reviews as a number of lawsuits wind their way through the system on their way to the U.S. Supreme Court. A three-judge panel heard two hours of legal arguments in one case last week and cast doubt over the legality of the law. "In 220 years...Congress has never once mandated a purchase," said Judge Kavanaugh of the U.S. Court of Appeals for the District of Columbia. He conceded, however, that the law wouldn't work in practice without such a mandate. Three federal appellate courts have already ruled on health care reform, two in favor of the Obama administration and a third finding that the individual mandate is unconstitutional. Four of the current Supreme Court justices (including Chief Justice John Roberts) formerly held seats in the D.C. Appeals court, however, so the ruling that comes out of this hearing is likely to get closer attention than others have. Making a decision in this case won't be an easy task, but American's all over the country will be impacted so I am hopeful this will get an expedited hearing before the U.S. Supreme Court.
